Public Offer Agreement for Receiving Charitable Donations
This public offer agreement (hereinafter referred to as the “Agreement”) is an offer addressed to individuals and legal entities (hereinafter referred to as “Donors”), from Boryviter M.S. NGO (hereinafter referred to as the “Organization”), regarding the provision of charitable donations for the statutory activities of the Organization under the terms defined by this Agreement.
1. Definitions
1.1. Charitable Donation – a voluntary gratuitous donation in the form of money made by Donors in favor of the Organization to achieve its statutory goals.
1.2. Offer – the Organization’s proposal addressed to an indefinite number of persons to conclude this Agreement under the defined terms.
1.3. Acceptance – the full and unconditional acceptance by the Donor of the terms of this Agreement.
2. Subject of the Agreement
2.1. The subject of this Agreement is the gratuitous transfer of funds by the Donor to the Organization’s ownership in the form of a charitable donation for the statutory activities of the Organization.
2.2. The Donor independently determines the amount of the charitable donation.
3. Procedure for Acceptance of the Offer
3.1. The acceptance of this Offer is the Donor’s making of a charitable donation through the payment system www.liqpay.ua.
3.2. The Donor’s making of a charitable donation signifies their full and unconditional acceptance of the terms of this Agreement.
4. Rights and Obligations of the Parties
4.1. The Organization undertakes to use the charitable donations received from Donors exclusively to achieve its statutory goals.
4.2. The Donor has the right to receive information regarding the use of their charitable donation.
5. Confidentiality
5.1. The Organization undertakes not to disclose information received from the Donor, except as required by the laws of Ukraine.
6. Other Conditions
6.1. This Agreement takes effect from the moment the Donor accepts the Offer and remains in effect until all obligations of the Organization to the Donor are fulfilled.
6.2. In case of disputes, they are resolved through negotiations between the parties, and if no agreement is reached, they are resolved in court according to the current legislation of Ukraine.
